In an action for a judgment declaring, inter alia, that the restrictive covenants and agreement contained in a certain conveyance are valid and enforceable and to permanently enjoin the defendants from subdividing the property described in the conveyance, the defendants appeal from (1) an order of the Supreme Court, Westchester County (Silverman, J.), dated September 26, 1997, which denied their motion for summary judgment dismissing the complaint and granted the plaintiffs cross motion for summary judgment, and (2) a judgment of the same court, entered January 16, 1998, which, inter alia, declared the restrictive covenants and agreement valid and enforceable and permanently enjoined the defendants from subdividing the property described in the conveyance.
